These Terms of Use ("Terms") govern your use of the AutoFocus mobile application and related services (together, the "Service") operated by SCMLC Group ("we," "us," "our"). By downloading or using AutoFocus, you agree to these Terms. If you do not agree, do not use the Service.
You must be at least 13 years old to use AutoFocus. If you are under the age of majority in your jurisdiction, you may use AutoFocus only with the involvement of a parent or guardian who accepts these Terms on your behalf.
We grant you a limited, personal, non-exclusive, non-transferable, revocable license to use AutoFocus on Apple-branded devices you own or control, subject to these Terms and the Apple Media Services Terms. All rights not expressly granted are reserved by SCMLC Group.
The Service, including all software, designs, text, graphics, interfaces, and the selection and arrangement thereof, is owned by SCMLC Group and protected by copyright, trademark, and other intellectual property laws. The AutoFocus name, logo, and all related marks are trademarks of SCMLC Group. You may not copy, modify, distribute, sell, or lease any part of the Service, nor may you reverse-engineer or attempt to extract the source code, except as permitted by applicable law.
AutoFocus offers auto-renewing subscriptions (monthly and yearly) and a limited founding offer for "Pro AF." The founding offer is a single purchase that never renews. Prices and durations are displayed in the app before purchase.
You retain all rights to photos and replays you create with AutoFocus. We do not upload, view, or store your photos.
If you claim a public profile handle, you grant SCMLC Group a non-exclusive, royalty-free, worldwide license to display your handle, shot count, fastest lock time, and streak on your public profile page for as long as the profile exists. Deleting your account from within the app removes the profile with it, and if you would rather keep the account and drop only the public page, email us at hello@autofocus.cam with your handle.
You agree not to: (a) use AutoFocus for any unlawful purpose; (b) reverse-engineer, decompile, or disassemble the Service beyond what is expressly permitted by mandatory law; (c) use automated means to access the Service (scraping, bots, etc.); (d) interfere with or disrupt the Service or its infrastructure; (e) use another person's likeness without their consent; (f) claim a handle that impersonates another person, entity, or brand, or that is offensive; (g) attempt to circumvent subscription or feature restrictions; (h) redistribute, sublicense, or commercially exploit the Service. Violation of these terms may result in immediate termination of your account without notice or refund.
The only thing you publish through AutoFocus is your handle, and we have no tolerance for handles that are hateful, harassing, sexually explicit, or presented as somebody they are not. Handles are screened when you claim them, every public profile page carries a link to report it, and anything reported is reviewed within 24 hours. Where a handle breaches this section we remove the profile and may terminate the account behind it, and that decision is ours to make.
Referral codes may be shared for personal, non-commercial purposes. We reserve the right to invalidate codes, revoke trial extensions, and suspend accounts involved in conduct that we determine, in our sole discretion, to be fraudulent or abusive. Decisions regarding fraud are final.
We run a prize draw for one photographer, drawn at the end of the first year following the public release of AutoFocus. Entry is free and no purchase is necessary: post a photo taken with AutoFocus to a public Instagram account and tag @autofocuscamera, and that post is one entry. Each friend who redeems your share code earns you one further entry. Holding a Pro AF subscription or the founding offer does not earn extra entries and does not improve your chances.
The prize is a cash pool that starts at US $1,000 and grows by US $10 for every Pro AF member, paid to the winner in a single transfer. The draw is open to entrants aged 18 or over and is void where prohibited by law. The winner is selected at random from all valid entries and contacted through the Instagram account that submitted the entry; if we cannot reach the winner within fourteen days, we may redraw. We may disqualify entries we determine, in our sole discretion, to be fraudulent, automated, or in breach of Section 6, and our decisions on eligibility and selection are final.
This promotion is run solely by SCMLC Group. Apple is not a sponsor of it and is in no way involved in it, and neither is Instagram or Meta Platforms. Any questions about the draw should go to hello@autofocus.cam rather than to those companies.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." SCMLC Group DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, SCMLC Group AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, REGARDLESS OF THE THEORY OF LIABILITY. OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS IS LIMITED TO THE AMOUNTS YOU ACTUALLY PAID US IN THE TWELVE (12) MONTHS PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR FIFTY US DOLLARS (US $50), WHICHEVER IS GREATER.
You agree to indemnify, defend, and hold harmless SCMLC Group and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to your use of the Service, your violation of these Terms, or your violation of any third party's rights.
We may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your license to use the Service ceases immediately. Sections 3, 9, 10, 11, and 13 survive termination.
These Terms are governed by the laws of England and Wales. Any dispute arising from these Terms or the Service shall be resolved by binding arbitration administered under the rules of the London Court of International Arbitration, conducted in English, with the seat of arbitration in London. The arbitrator's award is final and enforceable in any court of competent jurisdiction. You waive any right to participate in a class action or class-wide arbitration.
If any provision of these Terms is found unenforceable, the remaining provisions continue in full force and effect.
We may update these Terms at any time. Material changes will be notified in-app or by email. Continued use of the Service after changes take effect constitutes acceptance. If you do not agree with updated Terms, you must stop using the Service.
